What is a Simple Win?

Simple Wins are small, everyday victories you achieve in your life with diabetes that add up to big wins over time. One of Nick’s Simple Wins is being able to give back to the community and inspire others to do the same. That’s why Bayer Diabetes Care (a.k.a. Bayer Health Care LLC) and Nick Jonas are recognizing the good works of other people with diabetes who are making a special difference in their communities.

What is Bayer’s “Give Back. Simply Win.” Essay Contest?

Bayer’s “Give Back. Simply Win.” Essay Contest was designed to reward people with diabetes for their efforts to help give back to others. Bayer Diabetes Care and Nick Jonas hope that through this contest they can thank people like you with diabetes who support and inspire others, whether through volunteering or fundraising activities.

To enter, eligible participants with diabetes must answer three simple essay questions about their charitable efforts for a chance to have $5,000 donated to an eligible charity of their choice and meet Nick Jonas. A picture of each entrant will be uploaded to the site. Everyone can view the online submissions at www.contest.nickssimplewins.com. The Essay (that is, the three (3) answers to the questions on the entry form) must be the sole and original creation of contestant and have not been copied in whole or in part from any other work.

What is the contest schedule?

Contest Begins: May 4, 2010

Contest Ends: August 5, 2010
Grand Prize Winners Notified: On or about September 1, 2010

Grand Prize Winners Announced: By September 30, 2010

How many winners will be selected? What are the prizes?

Nine (9) Finalists will be selected, three (3) from each age category (age 6-12; 13-17 and 18+)

Each of the nine (9) Finalists will receive a sterling silver dog tag and a framed autograph picture of Nick Jonas. ARV: $25.

For each age category (age 6-12; 13-17 and 18+), one (1) Grand Prize winner will be selected from the three (3) Finalists in that age category, for a total of three (3) Grand Prize winners.

The Grand Prize Winners will each receive a donation for the charity specified in their Essay. That charitable organization will be awarded a $5,000 check from Bayer Diabetes Care. The three (3) Grand Prize winners will also each receive a trip for themselves and one (1) guest to meet Nick Jonas. ARV: $5,990

ELIGIBILITY

Who is eligible to enter the contest?

The Bayer “Give Back. Simply Win.” Essay Contest is open only to legal residents of the 50 United States and the District of Columbia (except for residents of the states of MA, MI, RI and where prohibited by law) who are 6 years of age and older at the time of entry and have been diagnosed with Diabetes and are not enrolled in a Federally Subsidized Healthcare Program such as Medicare, Medicaid, SCHIP or TriCare.

Who is NOT eligible to enter the contest?

Individuals who:

- do not have diabetes

- are under the age of 6 at the time of entry

- individuals who are enrolled in a Federally Subsidized Healthcare Program such as Medicare, Medicaid, SCHIP or TriCare

- who are residents of Massachusetts (MA), Michigan (MI), Rhode Island (RI), Puerto Rico or outside of the United States

- are employees, officers and directors of Bayer HealthCare LLC, Alcone Marketing Group and each of their respective parent companies, subsidiaries, corporate affiliates, advertising and promotion agencies, entities engaged in the design and implementation of the Contest, as well as members of their immediate family or same household

- employees of causes/charities/organizations/movements mentioned in the contestant’s submission

- are actively practicing licensed healthcare professionals (physicians, nurses, and certified diabetes educators) and their immediate family members (spouses and children)

- individuals not residing in the United States at time of entry

- have won a Grand Prize in any promotion sponsored by Bayer Healthcare LLC over the past 12 months

Why are residents of Massachusetts, Michigan and Rhode Island not eligible to participate?

Some federal healthcare laws may prohibit beneficiaries of federal or state healthcare programs from participating in contests such as the Bayer “Give Back. Simply Win.” Essay Contest.  As such, Bayer Diabetes Care, the Sponsor of the Contest, has decided to exclude beneficiaries of federal or state healthcare programs and, similarly, residents of those states with comparable state laws.

How do I know if my charity or cause qualifies for this contest?

Charity must be recognized under §501(c) (3) of the Internal Revenue Code (generally, a “not-for- profit” organization with a Federal Tax ID #). Donation will be made by Sponsor to Charity. Charity is subject to final approval of Sponsor, which may be granted or withheld in its sole discretion.

Why is this contest only open to people with diabetes?

Nick Jonas has teamed up with Bayer Diabetes Care to help inspire people with diabetes achieve their simple wins and live their dreams. We want to hear how people with diabetes are making positive changes in their communities, just like Nick Jonas.

If I don’t have diabetes, can I still participate?

If you do not have diabetes, you may not enter the contest but you can support people with diabetes by viewing the gallery of entrants and Essays on www.contest.nickssimplewins.com anytime during the Contest.

ENTERING THE CONTEST

How Do I Enter the Bayer “Give Back. Simply Win.” Essay Contest?

Follow these simple steps!

• Step 1: Visit www.contest.nickssimplewins.com and enter your date of birth

If you are under the age of 18 you will need a parent or legal guardian to enter for you or consent to your entry.

• Step 2: Enter a name for your entry and answer three simple essay questions.

1. “Which local cause/charity/organization/movement are you passionate about and why?”

2. “How are you currently making a difference for your cause?”

3. “If your entry was selected and you won the Grand Prize, how would you want the $5,000 to be spent by the cause/charity/organization/movement and why?”

• Step 3: Upload a photo so that we can celebrate your “Simple Win” on the Contest website.

• Step 4: Look for a confirmation email that your entry has been received.

How many times can I enter?

Only one (1) entry per person will be accepted.

What should I name my entry?

We recommend that you name your entry something relating to your charity or community work. However, the choice of name is entirely up to you.

How do I change or add to the information in my entry after it’s been submitted?

Once you submit your entry, it’s final and you will not be able to change or add anything to it. Please be sure to review your entry carefully before submitting.

PHOTO TIPS & RULES

By entering, each contestant (if 18 years of age or older) or their parent or legal guardian on behalf of contestant (if contestant is under the age of 18) represents and warrants that contestant’s Photo is the Photo of that contestant.

Photo can be in color or black and white and should only show the contestant. Entries received with individuals other than the contestant in the photo will not be accepted and will not be posted to the Contest website. Photo must be in the following file format: JPEG, GIF, PNG and cannot exceed 3 MB in size.

We highly encourage the contestant not to wear any items with brand logos clearly visible and avoid having any personal information in their photo because the photo will be posted on the Contest website (if accepted).

Photos that are not in compliance with these requirements (and entries including such photos) will not be accepted and will not be posted to the Contest website.

By submitting a name and Photo, contestant (if 18 years of age or older) or their parent or legal guardian on behalf of contestant (if contestant is under the age of 18): (a) grants a license to Sponsor and its agents to post the Photo and/or use contestant’s name (first name, last initial) on the Sponsor’s web sites, including www.contest.nickssimplewins.com or any other web site related to the Contest, or to use and edit Photo at any time or times, in any media, and contestant shall have no right of notice, review or approval of any such use of the Photo and/or contestant’s name; (b) acknowledges and agrees that the Essay (or any answer comprising the Essay) and/or his/her name, image or likeness may be used in whole or in part, alone or in combination with other works, and that the Essay (or any answer comprising the Essay) may be changed, altered, edited or modified, used in distorted, illusory or composite form, or in any other manner, as solely determined by Sponsor; (c) warrants and represents that contestant has received all rights, releases and permissions which may be necessary from the photographer of the Photo to grant this license for the use of the Photo as stated; and (d) shall provide specific written consent to any use granted above upon request of Sponsor.

FINALIST/WINNER SELECTION

How are the Finalists selected?

Bayer Diabetes Care projects that all approved Entries will be judged by August 15, 2010, on a scale of 1-15 using the following criteria: (a) Creativity, (b) Originality and (c) Persuasiveness.

There are three (3) age categories: age 6-12; 13-17 and 18+. The top three (3) entries in each age category with the highest cumulative score and will receive a Finalist Prize.

How are the Grand Prize Winners selected?

Finalists will be re-judged by Team Jonas on a scale of 1-15 using the following criteria: (a) Creativity, (b) Originality and (c) Persuasiveness. The Finalist in each age category with the highest cumulative score among the three (3) Finalists in that age category will receive a Grand Prize, in addition to the Finalist Prize.

How will I know if I am a Finalist?

If you are a Finalist, you (if you are 18 years of age or older) or your parent or legal guardian (if you are under age 18) will be notified by mail and required to complete and return documentation. This documentation includes an Affidavit of Eligibility, a Liability Release and, except where prohibited by law, a Publicity Release.

Other documents will be required including a letter from the Finalist’s physician on physician’s letterhead confirming that the Finalist has been diagnosed with diabetes as well as a document confirming that the cause/charity/organization/movement is a valid §501(c) (3) entity.

When will I know if I am a Grand Prize winner?

Winners (or their parent or legal guardian, if under the age of 18) will be notified on or about September 1, 2010.
